Flash TV Terms of Service

Welcome to Flash TV! Before you embark on your creative journey, we sincerely ask you to read the following terms carefully. These terms constitute a legal agreement between you and the operator of Flash TV and set forth your rights and obligations when using our services. By clicking to agree or by actually using our services, you acknowledge that you understand and accept all contents of these Terms.

We understand that the rules of the online world may seem complex, and we appreciate your patience. These terms are designed to protect you, all other users, and the legitimate rights and interests of Flash TV. Should you have any questions regarding any provision, please feel free to contact us. If you do not accept any part of these Terms, do not use our products and services.

Important Notice for Minor Users If you are under 18 years of age or do not have full civil capacity under the laws of your jurisdiction, you must read these Terms carefully together with your parents or other guardians and pay special attention to the provisions on minor protection set out in this Agreement. If you register for or use our services without satisfying the abovementioned requirement, all consequences arising therefrom shall be borne by you and your guardian, and Flash TV reserves the right to terminate your access to the services at any time.

Part 1: Agreement Basis and Scope of Application

Who do these Terms apply to? These Terms constitute the complete agreement between you (the User) and the operator of Flash TV governing your use of the services. All individuals and entities using any products or services under Flash TV are bound by these Terms. The “Operator” refers to the legallyestablished entity responsible for operating the Flash TV platform. The “User” means any individual who uses our services, including you.

Amendment and Update of Terms The internet landscape evolves rapidly, and our services are continuously developing. Flash TV reserves the right to revise these Terms from time to time in response to changes in laws and regulations, business development needs, or other reasonable grounds. The latest version of the Terms will be published on our service pages and shall take effect upon publication. Your continued use of our software and services after an update constitutes your acceptance of the revised Terms. If you do not accept the updated version, you must cease all use of Flash TV services.

Governing Law and Dispute Resolution These Terms shall be governed by and construed in accordance with the laws of 【Specified Jurisdiction】 (excluding its conflictoflaws rules). Part 2: Account Use and Security Safeguards

Account Registration and Login You may use part of our services quickly in guest mode without registering an account. However, we strongly recommend logging in via Google or another thirdparty account. This allows you to sync your creative progress across devices and effectively avoid data loss caused by account loss when you change devices or get loggedout unexpectedly. Your account is the key to enjoying full services. Please keep your username and password secure and log out after each use, especially on public devices.

Allocation of AccountSecurity Liability You understand and agree that you are responsible for safeguarding your own account. All actions performed under your account shall be deemed your acts. Any security issues resulting from account compromise, password leakage, or failure to logout caused by your inadequate safeguards shall be at your own risk, and you shall bear all related losses and liabilities. Flash TV shall be liable for accountsecurity incidents only to the extent of its own fault. Flash TV shall not be liable for damages arising from accountinformation leakage, unauthorized access to private data, or other security issues not caused by our fault.

ThirdParty Login Statement When you log into Flash TV through a thirdparty platform (e.g., Google), we employ multiple security technologies and comprehensive management mechanisms to protect your personal information from unauthorized access, public disclosure or leakage. You may review and modify the personal information you submit to us at any time.

Part 3: User Code of Conduct and Undertakings

What you may do Subject to compliance with these Terms, Flash TV grants you a personal, nontransferable, nonexclusive license to: Use the services for your personal, noncommercial purposes in the manner provided or permitted by us. Access all VIPmarked premium features within the app freeofcharge during your valid VIP membership period.

What you must not do To maintain a healthy platform environment and a positive experience for all users, the following acts are strictly prohibited and constitute a material breach of these Terms:

Unauthorised Commercial Use: You shall not use the services for any commercial or forprofit purpose unless you have a separate written agreement with Flash TV.
Unlawful or Inappropriate Content: You shall not publish, transmit or store content that endangers national security, undermines social stability, violates public order and good morals, or contains insulting, defamatory, pornographic, obscene, violent or terrorist material, or any content violating applicable laws and regulations.
Infringement of ThirdParty Rights: You shall not publish, transmit or disseminate content that infringes others’ intellectualproperty rights, trade secrets, reputation rights, portrait rights or other lawful rights and interests.
Unauthorised Plugins or Tools: You shall not use any thirdparty plugins, cheats or tools not authorised by Flash TV to interfere with, disrupt, or tamper with the services, or attempt to obtain source code or data.
Fraud and Misrepresentation: You shall not fabricate facts or conceal the truth to mislead or defraud other persons.
Abuse of Platform Resources: You shall not publish, transmit or disseminate advertising or spam messages; trade virtual currency among users; or giveaway, lend, rent, transfer or sell membership entitlements.
Violation of Local Laws: You shall not use the services to engage in activities that violate local laws, regulations or public morality, nor use the platform to participate in political or public events.

Consequences of Breach Upon occurrence of any of the abovementioned breaches, Flash TV may take measures according to the seriousness of the conduct, including but not limited to: deleting, blocking or removing links to infringing content; suspending or terminating your account access; restricting, freezing or banning your account; withholding fees you have paid as liquidated damages (we reserve the right to claim further compensation if our actual losses exceed such withheld amount); and reporting to and cooperating with judicial authorities where necessary. You shall be solely liable for all losses incurred by third parties or by Flash TV as a result of your breach.

Part 4: IntellectualProperty Statement

Our Rights All commercial marks, brand names, Logos used by Flash TV in the services, as well as all related information, materials, texts, software, audio, images, videos, graphics, interface designs, codes and accompanying software are protected by copyright, trademark, patent, tradesecret and other intellectualproperty rights owned by Flash TV or its lawful rightholders under intellectualproperty laws worldwide.

Your Obligations Without prior written permission from Flash TV or the relevant rightholders, you shall not modify, copy, distribute, transmit, publicly display, publicly perform, republish, license, transfer or sell the protected content, nor create derivative works based thereon. Violation of this clause also constitutes a material breach. Flash TV may immediately cease providing services to you and require you to destroy all such protected content in your possession. We may pursue corresponding legal remedies in accordance with the foregoing breachofterms provisions.

Content You Upload Any original content you upload, send or transmit through our services (including but not limited to web pages, texts, images, audio, videos) must be of lawful origin. You must either be the legitimate rightholder of such content or have obtained full authorisation from the rightholder. For the purposes of performing these Terms and delivering services to you, you grant Flash TV a worldwide, royaltyfree license to use such content within the scope of service provision. If a thirdparty rightholder alleges that content you disseminated infringes its lawful rights, Flash TV may, in its discretion, take measures such as deleting, blocking or disabling access to the relevant content to uphold the legitimate interests of the rightholder.

Part 5: Service Delivery and Your EquipmentRelated Responsibilities

Services Provided on an “AsIs” Basis You acknowledge and understand that our services are provided based on currentday technical capabilities and practical conditions. Flash TV will make reasonable efforts to ensure continuity, security and stability of the services but cannot foresee or fully eliminate all potential legal and technical risks. To the fullest extent permitted by law, Flash TV shall not be liable for: Service disruption or malfunction caused by force majeure (including but not limited to natural disasters, war, civil unrest, government actions). Service interruption, data loss or information leakage arising from factors beyond our control such as computer viruses, Trojans, hacker attacks, system instability or communicationline failures. Any loss caused by your improper operation or use of the services outside the scope of authorisation under these Terms. Other circumstances that Flash TV cannot reasonably control or foresee.

Your Device and Network You shall procure your own terminal equipment (e.g., computers, smartphones) required to access the services and bear all associated costs including communication and datatraffic charges. You acknowledge that using the services will consume part of your device’s system resources and network bandwidth, which is normal for internetbased services.

ThirdParty Products and Services When you use thirdparty products or services within Flash TV (e.g., completing topups via thirdparty payment providers), you shall comply both with these Terms and with the separate terms and rules of such thirdparty. Within the scope permitted by law and agreements, Flash TV and thirdparties shall each bear independent liability for disputes or liabilities arising from their own acts.

Part 6: Advertising and Commercial Promotions

Display of Advertisements You agree that Flash TV may, either directly or by engaging thirdparty advertising partners, show advertisements and other promotional content (both commercial and noncommercial) to you in the course of providing services. We may adjust advertising delivery channels, frequency and scope at any time without separate notice to you.

AdvertisingLiability Boundaries Flash TV shall perform necessary review obligations for the qualification of advertisers in accordance with applicable law. Nevertheless, you shall exercise your own reasonable judgment on the truthfulness, accuracy and reliability of advertising content. Except where explicitly required by law, Flash TV shall not be liable for any losses arising from advertising content itself or from offline transactions or purchases made in reliance on advertisements. You are responsible for your own commercial decisions based on advertising information shown on the platform.

Advertising for Paid Users Advertising revenue constitutes an important funding source that enables us to continuously deliver stable, highquality services to you and all users. Accordingly, even if you purchase Flash TV paid services or membership features, you may still receive platformserved advertisements. By reading and agreeing to these Terms, you acknowledge and accept this arrangement; advertisements form a valid component of the consideration for Flash TV to deliver fullfeature services to you.

Part 7: Membership, Paid Purchases and Topup Rules

VIP Membership Service Flash TV VIP members may access all VIPmarked premium inapp features freeofcharge during their valid membership period. Please note that membership is timelimited. If you do not renew before expiry, VIP privileges will terminate automatically upon expiration. VIP entitlements are for the sole use of the paying account holder and may not be transferred, lent, rented or sold between accounts. If we detect such unauthorised transfer, Flash TV may revoke the transferee’s membership and associated benefits without prior notice; all resulting losses shall be borne jointly by the transferor and transferee.

Adjustment of Pricing and Rules Flash TV reserves the right to independently adjust service pricing standards and charging rules according to market conditions, operating costs and other factors. Adjustments take effect upon publication on platform pages and form an integral part of these Terms. Different services, or different phases of the same service, may have different pricing; previouslyfree services may become chargeable. We will notify you in advance via onpage announcements before pricing or rule changes take effect. If you do not accept the revised pricing or rules, you may stop using the affected services; continued use constitutes acceptance of the updated terms.

AutoRenewal Service If you enable VIP autorenewal, you signify that you fully understand and agree to the following arrangements: Autorenewal shall only activate when you hold an active VIP membership. By enabling it, you authorise Flash TV to automatically charge your linked Google Play account for the next membershipperiod subscription fee shortly before your current VIP expires. If your Google Play account balance is insufficient for autocharging, your VIP service will terminate automatically at the end of the current subscription cycle. Cancellation Instructions: Charges will be processed through your Google Play account. To cancel autorenewal, you must complete cancellation at least 24 hours before the end of your current subscription period; otherwise your subscription will renew automatically. Cancellation path: Open the Google Play app → Go to “Home” → Select “Payments & subscriptions” → Tap “Subscriptions”, locate Flash TV and cancel your subscription.

VirtualCurrency Topups Certain platform products require virtualcurrency purchases; different products may use different types of virtual currency. Please ensure you use the correct virtualcurrency type for each purchase. Topup Precautions: Once a topup is completed, you may not request reversal or modification of the transaction. Carefully verify your account details and selected plan before toppingup. Flash TV shall not be liable for losses arising from incorrectaccount topups or wrongplan selections caused by your operational errors or misunderstanding of charging policies. ThirdParty Payments: If you topup via a thirdparty payment provider, you shall abide by all its terms and rules. Safeguard sensitive information such as bankcard numbers, passwords and SMS verification codes. Disputes arising from thirdparty payment services shall be resolved between you and the thirdparty; Flash TV bears no liability. Restriction on VirtualCurrency Trading: All usertouser virtualcurrency trading is strictly prohibited. If such trading is detected, Flash TV may take measures including blocking trades and freezing accounts; consequences shall rest with the relevant users. Handling of Topup Anomalies: Where platformsystem failure causes a discrepancy between the amount you paid and the amount actually credited to your account, we will resolve the discrepancy provided data is recoverable and you furnish valid payment evidence: if the credited amount is less than the amount you paid, we will makeup the shortfall; if the credited amount exceeds your payment amount, we reserve the right to recover the excess. Consequences of Breach and Account Ban: If your account is frozen or banned due to a breach of these Terms, your toppedup funds and related entitlements shall not be refunded, and you shall have no claim for compensation against Flash TV. No Refund after Consumption: Once you purchase episodes or paid content on Flash TV, subscription modifications or refunds are not available. Even if platform services are suspended or interrupted, or purchased episodes are removed from the platform, consumed virtualcurrency and paid sums will not be refunded. For paidepisode purchases, Flash TV only guarantees normal playback for onemonth from the date of purchase. Flash TV shall not be liable for playback malfunctions occurring after this validity period.

Part 8: Liability Limitations and Risk Warnings

Force Majeure You acknowledge that forcemajeure events may occur during service use, potentially causing service disruption or data loss. Force majeure means objective circumstances that are unforeseeable, unavoidable and insurmountable, including but not limited to natural disasters such as floods, earthquakes, pandemics and storms, as well as social events such as war, civil unrest and government regulation. Upon a forcemajeure occurrence, Flash TV will make reasonable efforts to support restoration work. To the extent permitted by law, we are exempt from liability for any losses or damages incurred by you as a result.

OnlineInformation Risks You understand that inherent risks exist from online information and otheruser conduct when using the services. Flash TV makes no representations as to the truthfulness, accuracy, availability or legality of information on the platform and shall not be liable for harm caused to you by otheruser behaviour. Such risks include but are not limited to: Content posted anonymously or under false identities by thirdparties that may contain threatening, defamatory, offensive or unlawful material. Psychological, physical or economic harm caused by misrepresentation or deception by other users. Other potential risks originating from the online environment or usertouser interactions.

Disclaimer for SpecialPurpose Use The services are not designed for safetycritical applications such as nuclearfacility control, military use, medical equipment, transportation or communication systems. Flash TV shall not be liable for personal injury, death, property loss or environmental damage arising from system or service failures in such scenarios.

Clarification on PlatformMonitoring Obligations Flash TV has the right to remove unlawful or breaching content under these Terms. This right shall not be construed as imposing an exhaustive monitoring obligation on the platform. We cannot guarantee timely detection and handling of every breach. Please report objectionable content to us if you encounter it.

AntiFraud Reminder Do not trust suspicious online messages involving fund transfers or requests for account passwords. Always verify the identity of counterparties through reliable channels before conducting any financial transactions. Follow platform antifraud prompts and maintain selfprotection awareness.

Part 9: Minor Protection

Special Considerations Flash TV attaches high importance to minors’ physicalmental wellbeing and personalinformation protection. Users under 18 years of age are minors. We recommend that you read these Terms and use our services under the supervision and guidance of a guardian.

Usage Guidelines for Minor Users Minors have limited life experience and may be easily influenced by online content. They are curious yet have relatively inadequate selfprotection capabilities and are more vulnerable to harm in online environments. While enjoying creative activities, minor users should pay particular attention to the following:

Distinguish Virtual from Reality: Properly differentiate the online world from reallife; avoid excessive internet addiction that interferes with study, daily life and social interaction.

Guardian Responsibilities We call on guardians, schools and society to pay attention to minors’ use of online services. Part 10: Service Modification, Suspension and Termination

Dynamic Adjustment of Services Flash TV is committed to improving service quality and may adjust, optimise or upgrade service contents and functional modules according to business plans. To the extent permitted by law, Flash TV may modify, suspend, interrupt or terminate all or part of the services. Where feasible, we will give reasonable advance notice.

Grounds for Service Termination without Notice Flash TV may interrupt or terminate service provision to you without prior notice in any of the following circumstances:

You are required by law to provide truthful personalidentity information, yet you submit false or inaccurate information, or information materially inconsistent with your registration details without reasonable explanation.
You violate applicable laws, regulations or any provision of these Terms.
Competent government or judicial authorities issue relevant official orders or requirements.
Measures are reasonably necessary to safeguard service security or platform stability.

PostTermination Handling After service termination, you will no longer have access to Flash TV services. We may process your account information and stored data in accordance with legal requirements.

Part 11: ThirdParty Complaints and Content Handling

If thirdparty rightholders claim that content you upload, send or transmit via our services (including but not limited to web pages, texts, images, audio, videos) infringes their lawful rights, Flash TV may prudently process such content upon receiving the rightholder’s notice. Available measures include but are not limited to deleting content, blocking access to content, or removing relevant hyperlinks. You understand that Flash TV must exercise neutral judgment in such cases. If you believe a decision is erroneous, you may file an appeal through our published official channels.

Your Undertaking for Uploaded Content All content you upload or transmit through our services must be of lawful origin. You warrant that you hold full intellectualproperty or other legal rights in such content, or have obtained valid authorisation from the rightholder. Otherwise you shall bear all resulting legal liabilities.

Part 12: Miscellaneous Provisions

SoftwareUse License To use our services, you need to download and install the Flash TV client software. Flash TV hereby grants you a personal, nontransferable, nonexclusive license to use the software solely for lawful access to our services. To continuously enhance user experience, ensure service security and functional consistency, we release software updates from timetotime. Please update to the latest version; Flash TV does not guarantee continued proper operation of olderversion software.
